These End User Terms (hereinafter referred to as "Terms") establish a set of rights and obligations between you and us (hereinafter referred to as "the Application") to describe the details of the services provided by the Application to you and your use of the services. Therefore, please carefully read these Terms and Conditions before registering as a user of the Application or using the services provided by the Application.
By completing the registration process or starting to use any of the services provided by the Application, you unconditionally accept and are bound by the relevant provisions of these Terms and Conditions and the administrative regulations published by the Application regarding the usage of their services. In case of a dispute, you shall be responsible for not having read these Terms and Conditions carefully and shall not be able to defend yourself on the basis of not having read them.
This application offers different services to you through various software or tools such as the iOS version and Android version of the software. Unless otherwise agreed, the provisions of this Agreement will automatically apply to any version update of the Application or addition of new features or services.
The Application provides both free and paid services to you. Before providing any paid services, the Application will give you a clear indication and will only provide such paid services to you if you agree to pay the corresponding fees based on the indication. If you refuse to pay the fees, the Application reserves the right not to provide those services to you.
If you allow the Application to use network traffic, the operator will charge you for the traffic, and the Application will not receive any revenue from it. You are responsible for any equipment such as personal cell phones and other devices required to access the Internet or mobile networks and for the costs such as telephone and Internet access fees for accessing the Internet and cell phone fees for using mobile networks required to use the Application.
When you register with the Application, you must provide the necessary registration information as required by the Application. To obtain the complete service provided by the Application, you are required to provide true identification information and keep such information updated online in a timely manner. If the information you provided is not true or has been changed but not updated, or is in any way misleading, and as a result, the Application cannot provide or continue to provide services to you, you shall bear the loss arising therefrom at your own expense and not at the expense of the Application.
You understand and acknowledge that the ownership of the Application account belongs to the Application, and the right to use the Application account belongs only to the original registrant. Without the prior written consent of the Application, you may not transfer, give, lend, sell or otherwise permit third party use of the Application account and password other than by the original registrant, or the Application has the right to block or delete the account. If you are not the original registrant of the account you are currently using, you should immediately stop all use and operation of the account, and we have the right to reassign the account to the original registrant at the request of the original registrant or at our own discretion, and all responsibilities and losses arising therefrom shall not be borne by the Application.
You are obligated to keep the account and password secure, and the Application shall not be responsible for any loss caused by the illegal use of the account and password by others due to hackers, third-party actions, or your own negligence in keeping your account and password.
If you discover that your account has been illegally used by others or has abnormal usage, you should immediately notify the Application of the issue and provide valid personal identification information consistent with the original registrant. After verifying the validity of your provided personal identification information, the Application will provide you with necessary assistance in defending your legal rights as much as possible, but we do not promise that you will be able to recover your account through this way.
You are responsible for using the Application in compliance with relevant local laws and regulations, as well as the Terms and Conditions and relevant administrative regulations issued by the Application. You must not infringe the legitimate interests of third parties or the Application, and must not use the services provided by the Application for any illegal or infringing activities. This includes, but is not limited to, displaying or transmitting materials containing pornographic, racist, vulgar, obscene, defamatory and libelous content, as well as any content involving hatred, discrimination, or prejudice against religion, national tradition, ethnicity, gender, or age.
We reserve the right to review and monitor your use of the Services. If we believe, based on our own independent judgment, that you have violated any law or contract, we have the right to require you to correct such behavior and to take all necessary measures (including but not limited to changing or removing the content you post or upload, suspending or terminating your right to use our Services, etc.) to mitigate the impact of such behavior. Please note that our review actions do not create any liability for us or relieve you of any obligation.
You are responsible for ensuring the legality and legitimacy of your own use of the Software. You must not decompile, disassemble, or crack the Client. Please do not abuse or interfere with the Software Service, including but not limited to using the Software Service for illegal purposes, tampering with the computer code associated with the Software, using logos or text associated with the Application, attacking the servers of the Application, deleting, hiding or modifying any statements associated with the Software Service, etc.
When you use the Application to publicly post content (such as comments), you must comply with social order and morality as well as relevant laws and regulations. You must not post or upload content that violates the basic principles established by the Constitution, local laws, regulations, and other provisions, or that violates social order and morality and is detrimental to the public interest of society. You must not post or upload files or information that violate the legitimate rights and interests of third parties, including but not limited to virus codes, hacking programs, software cracking registration information, etc. You must not post or upload articles, pictures, music, videos, applications, etc. that have not been legally authorized, illegal or harassing advertising content or links, or that violate the application's information distribution policy or damage the legal rights of the application.
We reserve the right to review the content you post and upload. If we believe, based on our own independent judgment, that the content you post or upload contains any of the aforementioned prohibited materials, we have the right to directly remove the relevant content without any notice to you. Please acknowledge that our review actions do not create any obligation on us or relieve you of any responsibility.
You are responsible for any legal disputes or other consequences arising from the content you post and upload. You are required to provide a full disclaimer of liability for the application. The rights contained in the content you create while using the Application remain yours by law. However, by posting or uploading any Content to a publicly accessible area through the Application, you agree to grant us a free, perpetual, irrevocable, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works based on, transmit, perform, and display such Content (in whole or in part), and/or to incorporate such content into any other work, media or technology now known or hereafter developed.
We reserve the right to restrict your use of the Application if we believe, in our sole discretion, that your use of the Application is beyond reasonable limits. You assume all liability and damages arising therefrom.
We take the protection of your personal data and privacy very seriously. We are committed to taking necessary measures to protect the security of your personal data and private information stored on our servers. Please refer to our Privacy Policy included in this Agreement for information about the data we may collect in the course of your use of the Application. We promise not to disclose or provide your personal data and private information to third parties, except as provided in this Agreement and the Privacy Policy.
We attach great importance to the protection of our own intellectual property rights and those of third parties. The copyright, patent, trademark, trade secret, and any other proprietary rights or rights related to the services provided by the Application itself are exclusively owned by the Application. You may not use them for purposes other than those permitted in writing by the Application without the Application's consent.
Your use of the services provided by the Application does not entitle you to acquire or own any intellectual property rights belonging to us or third parties. All rights to all content linked to from the Application belong to the author or third-party websites. Please do not distribute, copy, adapt, modify, or otherwise improperly use the works of others, including but not limited to reproducing, linking, downloading, copying, editing, modifying, altering, uploading, sharing, distributing, performing, deriving other works, creating derivative works, defaming, or defeating technical protection measures of the works.
We are not responsible or liable for the legality, accuracy, completeness, and reliability of third-party website content (such as videos, music, applications, etc.), user-stored content, user-posted content (such as images, comments), and other content linked to or from such content (such as advertisements, promotions) that is not directly provided by this application. No warranty, express or implied, including but not limited to warranties of title, quality, non-infringement of third-party rights, or freedom from viruses is made with respect to such content.
The application will do its best to provide you with stable services, but you should use the application at your own risk. We do not make any promises or guarantees and do not guarantee that the service will not be interrupted. We do not assume any responsibility for your data loss, loss or service discontinuation due to any reason such as network bandwidth, phone (or other electronic devices) hardware limitations caused by your normal use of the software. We are not responsible for any legal liability.
If the application provides some particularly risky features, we may ask you to confirm them. If you click to confirm or use the corresponding function, you will assume the corresponding risk. If you suffer actual losses as a result, you will be responsible for such losses.
The services provided by this application are subject to the risk of interruption or failure to meet your requirements due to factors including force majeure, computer viruses or hacker attacks, system instability, your location, communication lines, the application's own operational adjustments, partner adjustments, etc. The application may change, interrupt or terminate some or all of the services at any time without separate notice to you. Please take care to back up your data stored on our web services regularly to avoid losses.
If you wish to use the application's services, you do so at your own risk. We shall not be liable for any damages suffered by you or any third party as a result.
The interpretation, validity, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan). Any dispute arising out of or in connection with the use of the Application must be submitted to the Beijing Arbitration Commission for settlement by arbitration. The arbitral award shall be final and binding on all parties.
We reserve the right to make changes to this Agreement and its components at any time. In the event of a change to the terms of this Agreement, such changes will be posted on the Application as soon as they occur. If you do not agree with the modifications to this Agreement, you should immediately stop using the Application. If you continue to use the Application after the changes to this Agreement, you are deemed to have accepted and are willing to comply with the modifications to this Agreement.
If any provision of these Terms is determined to be partially or wholly invalid under the relevant provisions of China's laws and regulations, the validity of the other provisions shall not be affected.
The failure of the application to take action to stop your breach of contract or to pursue liability does not mean that the application waives such rights under the agreement.
